    With this issue of priority date taking a back seat to notice date when dates are current :

    While it is frustrating to the people with older priority dates (including me); it could very well be that USCIS is approving people with later priority dates sooner because its simply easier for them to do so. I really hope that this trend does not last beyond Aug-Sep. And in October, for EB2 - I, there is still a good likelihood that for people with priority dates < 2004, dates may still be current. So they can very well be approved from Oct onwards. So if I have to sacrifice a few months of waiting time to make sure visa numbers dont go wasted. I am prepared to do so.

    Also it is very likely that people with older priority dates have a longer history in the US. So USCIS might need more time correlating all entry/exit time stamps, making sure we were in status all this while; but a person with 2006 priority date might have entered the US in 2005 & so less history to check.

    Also there is the case where later priority dates were using PERM. since PERM was made to be less abusive than the previous LC process, maybe they take less time cross checking LC data.

    It is unfair. So is life. Do I think a person with EB3 with priority date 2002 needs to wait 5 more years than a person with EB2 priority date 2006. No thats unfair as well.

    Complaining issues such as this to the authorities will only make one thing clear - The current US immigration is full of such vagaries. It needs a clear & complete over haul. Thats not gonna happen soon.

    For now, I think we just be satisfied with our EAD cards & AP & wait for the GC when it comes. It will be little less frustrating if we dont keep looking at immigration trackers.

    Let's start our campaign for our own bill immediately. There is no motive to wait. We should pay lobbysts and ask them to approach lawmakers using the argument that legal immigrants need a relief without waiting for amnesty bills for illegal aliens.

    The same argument applies, why would someone like Dianne Feinstein or other lawmakers who supported CIR because of industries such as agriculture, turn around and support a bill for legal immigrants when they traditionally have been opposed to bills that favor skilled workers ? The reality is that there will be no new bill until after November. I'm being pessimistic with good reason, look at the example that this Senator (http://www.senate.gov/~levin/newsroom/release.cfm?id=256689) gave regarding a measure that made it to the Senate and collapsed, but they did have success in the house where it passed as they would have wanted it to. What happened in this same case is what has happened to CIR, it got past the Senate but is now facing problems in the house. It goes to show that lobbying even with massive resources does not guarantee immediate success neither is the result what one set out to get, but indeed one is better off lobbying than not lobbying at all :

    18 families worth a total of $185.5 billion quietly financed and coordinated a 10-year effort to repeal the estate tax. The report (http://www.citizen.org/documents/EstateTaxFinal.pdf) tells how these families spent over $200 million dollars contributing to political campaigns, financing outside lobby groups and trade associations, and creating a massive anti-estate tax coalition that served as the main coordinator of the repeal campaign.

    My concern is that if CIR does not get taken up sooner that May07...it may be postponed to 09 due to election politics being a hot potato issue...what I would suggest is that we start working from the first day the congress starts and whether through QGA or through indiviual senators try to pass just non-contraversial benefits like ability to file EAD after I-140, recapture of Visa numbers and Spouse and kid not included in the Visa numbers and intorduce this bill and try to pass it.

    What we need is a interim EB bill.


    The first stpes may be to indentify all non-contraversial issues and then come to a common understanding on those...advise all state chapters meet thier senators about these same issue(ALL members are talking the same)
    Intorduce these no later than End of Jan 07 for discussion. in senate..Lets explain to them that its going on getting postponed due to the fact senators are postponing the benefits to us syaing it will be included in the CIR...and so on...they have been very sincere in delaying this intentionally....


    If we need to get started on the first day of congress I suggest we start getting organozed now...

    Hilarious.... Hilarious.....

    1) EB2 with PD like 2007 and 2008 will certainly oppose. It is understandable. But why many EB3 folks themselves oppose it? Because they are with "looser mentality". EB3 folks, listen! No body cares about you. Then why do you care about other categories. Don't be a looser. Take care of your problem first.

    2) The lawyer was suggesting us to convert to EB2. You bet. Dont you know why?

    Most of the EB2 got their GC. The only loosers are EB3. With IV's reach it can easily help EB3. I told this many times before. But IV core is saying it will be very hard to even do a simplest releif measure. I simply do not understand. I hope and pray IV core will listen this time.

    I suggest you drop out of EB2, and learn some English spellings before coming here and chiding people. Get lost!

    The answer is in your question. Numbers. A few years ago (circa 2002-) no one complained much about Indians. Recently the complaints in the media/forums etc. are much higher. Why ? More H1, => more bodyshoppers (mainly India) => more abuse => more complaints and so on.

    Also FYI, H1 is "temporary" just like F1. H1 is not a guarantee to GC. So you need to go back after 6 years, since you say F1 should leave after graduation.



    Thats my point. Why are pakistanis getting green cards and nobody is saying they have taken jobs away from Americans? So many come to US on visa free travel, work 6 months undocumented from european countries, yet they are the first to get the GCs while Indians abuse B1, they abuse H1. How come only Indians abuse everything no one else abuses anything?

    There are many points on which this agreement can be defended.
    1. No fixed time period. Staying upto 1 year after getting GC is same as saying work until the car engine for the company CEO's car goes out. Nobody can predict either one.
    2. Usually waiver of filing lawsuit by employee involves sum of money for its consideration. Many employer pay employee month salary (or part/multiple) to offer agreement for not suing. Agreement terms without consideration are usually null and void. For example, I can't have agreement with you that you will deliver free newspaper without stating consideration/compensation for you.
    3. Company can claim for GC Expenses and other related expenses if employee leaves within reasonable and agreed period. So probably $10,000 is in the agreement to cover that.

    Now for the bad news, defending this agreement could cost much more than $10,000, besides time and hassles. More so, if employee and employer are in two different states as employer can file suit in their state. In short, $10,000 is cost of moving out of this job at the time of your choice. You could also look at it as the added cost of GC.

    I suggest you should consider making a plan to move in your life and career. As they say, freedom is priceless.

    My I-485 was delivered to NSC on June 26th. I-140 is approved from TSC. I did not get my receipt yet so I talked to my attorney, she said the case may be transfered to TSC. TSC receipt completion date 6/26, considering the tranfer time of 2 more days we may get our checks cashed by this week. I hope this become true!

    My I-485 was received by NSC, on Jun 25th. Called USCIS today, they said information is not in system. Lawyer is also not repsonding, if checks are cleared. My previously approved I-140 from TSC has a LUD of 08/05/07.

    As we get closer to election day it seems that Democrats will have control of the Congress. All the polls that have been and are being conducted show that the Democrats are leading the Republicans by double digits.

    If Democrats win the CIR will get through but the there will be a huge backlog as there arent enough people at USCIS to do the work, which in a way is retrogession. There will be relief for people with advanced degrees but on paper only.As it will still take years for their paperwork to get through USCIS, others will be in a worse situation as the waiting line would be huge.

    If Republicans win there will be no CIR as pointed out by others in the thread. However, SKIL might get through and that will help shorten the waiting period for people without advanced degrees.

    Based on my analysis (which might be completely wrong), I think we are better off with Republicans.

    I know this might have been discussed but when is the RD if the application is moved (by uscis) from NSC to TSC?

    My I140 was approved by TSC sometime back. My 485/EAD/AP were sent to NSC in first/second week of July. Finally got the receipt last week. The receipt says that my application is received on Sept 5th - which is not true (it was sent in JULY); based on this notice it seems they are recording the RD as the day when they enter the application details in their system and not the day when it is actually physically received by them.

    I thought its other way round based on FAQ. Am I missing something? is it worth calling them on this? Thanks.

    EB2 - India
    PD - Sep/2006
    I 140 approved - Dec 2006
    I 485 Date received July 2nd 2007
    RD - checks were cashed (date - July 30, 2007)
    FP - Got a mail from USCIS regarding finger printing (scheduled - August 29,2007)

    So far no receipt by mail, application is at Nebraska.

    Yo man, you are one lucky dude! Nebraska hasn't issued many fp mails to July filers.

    Just came back, here is my report:

    - There were five Chinese and seven Indian people at the march. It was small fun group.
    - The group was small but the outcome as you will note from my report below was productive
    - Fighnow, who is the Chinese member of mittb.com had initiated this 7th July march, because of the short notice we couldn't publicize this event but still it was good to see a bunch of people show up.
    - Fightnow, and his friends were fully prepared with big banners and all, with appropriate slogans
    - In the beginning there was some police presence but they left an hour later, I guess because of a small group
    - We carried our placards and banners on the sidewalk and got lot of "honk" support from people driving by.
    - Luckily a Chinese TV station happen to be in the area and interviewed many of us. The station is called KCSN 30, if I remember correctly and this news story will air on Monday evening in Bay area. I will post details about this after hearing from fightnow.
    - The parking is free on weekends.

    What we need to do is:
    - Organize a bigger march on 14th July
    - Organize a similar event in DC if possible so get more mileage
    - Prepare some banners and placards etc.
    - Bring water, it was warm
    - Have fun

    I disagree.
    Why is it not easy to change from EB3 to EB2?
    We have to decide what is important in life for us. Current job/salary/promotion/ status quo or Geeencard?
    If someone wants EB2, they can change their job and apply again. The law does not prohibit that. So stop blaming unfair laws.

    So the only reason why a lot of us are in EB3 is becasue we have chosen to stay with the current employer who pays us well and do not want to take the risk of a new employer. So it is our choice and not injustice. The system allows us options. We cannot want a cake and eat it too. I am also trying to find a new employer to change my job and file in EB2. Everyone is free to do that.

    And stop claiming that you are fit for EB2 but are stuck in EB3. If you are fit for EB2 then why don't you apply in EB2? If you have a masters degree you can find a new job with EB2 that needs a masters degree. Anyone who does not have masters degree then get work experience and change your job to file in EB2. Ultimately we have to decide what we want.

    yes, technically that is possible. But practically it may not be possible for the same reasons you said.

    And to me they are valid. So you are asking some one in EB3 2002 to quit his current job and apply for EB2 because the system is inefficient and cannot grant him GC in 7 years and if tomorrow he does not get under EB2 as well, you will advocate him to file under EB1??

    You are asking to adjust my body size to fit a dress instead of altering the dress itself. Just because the system provides 100 loopholes/opportunities/possibilities, does not mean one has to explore everything to get justice from the system. As I said, not EVERYONE can do that. Nevertheless, it is easy to give advise.

    Why SKULL bill ? As a high level manager I have learned after years of experience that you need to use good sense of humor, satirize when confronted with insanities and very stressful situations. In my life such a twaddle this immigration process has been that I need to come up to this forum and sometimes make some of us laugh a little bit from this situation. Calling it SKULL bill is a way to apply my sense of humor to this process. Please do not take this as an offense.

    Please, please. Folks, didn't you see immigration-law.com and AILA.org - a reliable pro immigration sources - outlining that that anti CIR calls outnumbered the pro CIR calls 400:1 ? Go to AILA.org and research the info there by yourself if you don't trust me.

    One more indication for you, which doesn't rely on biased polls:
    In spite of massive lobby and muscles leveraged by the corporate sector, why do you think immigration bills - both pro legal and pro illegal - have been unsuccessful in the last two years ? Come on guys, by now you should not be questioning whether the public is against amnesty or even legal immigration. It is evident that the majority of citizens do not benefit from more immigration. Do you have an idea how much lobbying $ got involved on this without much success so far ? I am surprised that you are even raising this question. Why Americans should want more foreigners to compete with them when the real wages have declined ? That would defy logic.

    I have mentioned IV to a some Indians. They have no interest. Some of them are not bothered about retrogression. They exepect the GC to fall in their lap while they are sipping tea and eating samosa.

    Also, it is hard to trust a mainly Indian set up. The Indian contracting companies have set a very shameless level. I told my friends that IV appears different but it is hard to change your opinion when you see something else 10 times a day.

    I apolozie to the sensitive Indians if I this is breaking news. But this is the general feeling and a reason for hate in the blogs: where there is smoke there is fire. It is embarassing.

    For the life of me, I couldn't figure this out either.
    I also don't understand why most of EB applicants are so oblivious to the EB-based immigration situation.
    I am from ROW, and I could only shake my head in disbelief when one of my Indian friends asked me innocently if the 'situation' was 'really that bad'?
    If there really are 600K EB applicants, and all we can get is 6K members, then perhaps we deserve the crappy situation we find ourselves in today.
