Thanks to basha for asking question to an attorney. Hopefully Ron answers it.
Thanks to vbkris77 for posting it in this thread.
VB Core,
Is it possible to get a quick clarification from a forum-attorney ?
I saw someone already asking this question in Ron Gotcher's immigration forum.
http://www.immigration-information.com/forums/showthread.php?t=7988
That is a good thing. Lets keep our fingers crossed.

As I mentioned earlier I have to land in Canada, now I am thinking of using AVR. My expired H1B was from Company A then I shifted to company B. I now have H1B extension and valid I-94 from company B.
Can I still use AVR? I didn't find the answer, anybody who used AVR(similar scenario like mine) can u plz reply....
Thanks in advance.

We are all missing a point here.
Someone with a PD of 2006 who filed his/her AOS in 2006 should be far ahead in processing compared to someone with a PD of 2001(or who has been in the country for the last 20 years) but applied just a week ago.
Should USCIS hold the first case and wait for the other case to reach that stage? They can certainly do that if we don't blame them for wasting visa numbers every year.
It's not as simple as it sounds --Give GC to those old timers before the new comers!
Having said that, It certainly makes more sense to have some system which would atleast honestly attempt to be fair to the old timers.
BTW, I'm an old timer myself, 7th year in the country and a PD of 2003.
I would rather have them approve ANY case instead of wasting a single visa number.
If you mean what you were saying, then per me, approving pending CP cases (which are already at the consulate just awaiting VISA numbers) atleast the last few days of September (of every year) -if there are NO ELIGIBLE 485 cases would be the best way to utilize every single VISA number.
485 cases may be waiting for several reasons - case not processed yet, name check, RFE, FP etc. But cases in CP wait for just one reason - no VISA number - but still VISA numbers are wasted by the end of every year. Why CP cases do not get VISA numbers? because PD is not current. They are ready to waste VISA numbers instead!

AILF is ready to take the cause up, then why not ? Fragmon & Rajiv Khanna are just two opinions. I think the Congresswoman who spoke out on this issue used to be an immigration lawyer prior to taking up public office & she mentions in her letters to DHS that this may be a potential violation of the law.

This is a law violation and I have URL for it. In fact, the law also says that there is a 10% quota for each month.
As I have posted earlier there are other issues. Thus, this is another issue and not the whole issue.
Pursuing this issue and violations of name checking does not get us much. They can cancel some GCs issued but still not accept July AOSs.
We need to concentrate on issues that support accepting July AOSs.
that is why i am raising it in that manner (and not mentioning security)
they are actually issuing those approvals in july
i am saying- until the LAST APPROVAL is complete, GC numbers are available.
they circumvented that by pre-alloting the numbers to cases
these cases could be rejected in the final days and a number would be back in the pool. therefore they should accept aos until they have approved all those cases finally
the pre-allotment was a sleight of hand to avoid the filings. they are actually doing the july approvals now as we speak and sending them out.

Section 245.1 (g)
(g) Availability of immigrant visas under section 245 and priority dates—(1) Availability of immigrant visas under section
245. An alien is ineligible for the benefits of section 245 of the Act unless an immigrant visa is immediately available to him or her at the time the application is filed. If the applicant is a preference alien, the current Department of State Bureau of Consular Affairs Visa Bulletin will be consulted to determine whether an immigrant visa is immediately available. An immigrant visa is considered available for accepting and processing the application Form I–485 if the preference category applicant has a priority date on the waiting list which is earlier than the date shown in the Bulletin (or the Bulletin shows that numbers for visa applicants in his or her category are current), and (if the applicant is seeking status pursuant to section 203(b) of the Act) the applicant presents evidence that the appropriate petition filed on his or her behalf has been approved. An immigrant visa is also considered immediately available if the applicant establishes eligibility for the benefits of Public Law 101–238. Information concerning the immediate availability of an immigrant visa may be obtained at any Service office.

Great news for IV as it will enable him to be more aggressive now!
Aman, open a consulting company( non-profit ;) ) and we'd be happy to invoke AC21 in 6 months :)

Hi Mehul,
very sad to hear your condition. We do have good medical treatment available everywhere. Get the best treatment. I have seen so many people recoved from cancer. Hope you will be the one among them. Don't give up hope and spirit. Hope both you and your family will get GC very soon.
Consult a good attorney what to do immediately.
I will pray for you.
Wish you all the best to you and ur family

Folks it has been long time I last wrote here but this visa bulletin made me mad (sorry)
So I went and downloaded all the FLCDataCenter.com (http://www.flcdatacenter.com/CasePerm.aspx) data from 2000 till 2008. It looks like they recorded all the pre perm cases as well. After this I exported all the stuff into mysql table and made some calculation on the labor certification data. Unfortunately cannot separate (e1,e2,e3 etc some may want to try by country but )
Again this is PERM labor certification!!1 - but has to do with GC I guess...
Time frame 1999 Oct -2008 Oct:
Sum of cases: 720486, like '%CERT%' = 554635 (certified), like '%Deni%'= 60043 (denials), (Non duplicate case numbers were = 715191 (i.e. 5295 duplicates only from the 720486) )
There were ~100000 cases with some other state descriptions like Withdrawn = 13955, Received Regional Office = 69556 etc;
Anyway, by grouped years it comes to (sum certified + denials +etc):
last action date with "null" entry ?? 34113
between '1999-10-01' and '2000-10-01' 74048
between '2000-10-01' and '2001-10-01' 82629

between '2007-10-01' and '2008-10-01' 61997
Guess work (nbr of labor certs are 10% less in each group denials are not removed):
Still wait - % how many of that group still waiting (some can give a better guess??)
